Six workers at the Tyson Prepared Foods, Inc., plant in Jefferson, Wis., have won an appeal over whether they should be paid while putting on and taking off protective equipment and clothing.
The 4th District Court of Appeals on Thursday reversed a ruling of the Jefferson County Circuit Court, which ruled in favor of the company. The lower court said Tyson did not have to pay the workers during those times because putting on and taking off the gear was not integral and indispensable to their work activities.
But the appeals court disagrees and says it is an integral part of their jobs and therefore they should be paid during that time.
Tyson's plant in Jefferson primarily produces pepperoni for pizza toppings.
