Judge hears arguments on voting rules lawsuit
A district court judge is considering whether a lawsuit filed by civil rights groups against Iowa Secretary of State Matt Schultz over new voting rules should be dismissed or allowed to go on.
Schultz attempted to pass two emergency rules prior to the Nov. 6 general election, but Polk County District Court Judge Mary Pat Gunderson halted them. One would have challenged votes of individuals who appear on state and federal databases as noncitizens. A second rule would have made it easier to report alleged voter fraud.
Schultz wants the case dismissed. His attorneys argued Friday in a hearing that he's now pursuing a different set of rules in the regular rulemaking process and the emergency rules no longer matter.
Gunderson says she'll consider arguments and decide soon.
