The man convicted of killing a father and son at their downtown La Crosse business wants a new trial but Monday La Crosse County District Attorney Tim Gruenke said he shouldn't get it.

A jury found Jeffrey Lepsch guilty of killing Paul Petras and his son AJ at May's Photo about two years ago.

About a month ago Lepsch's new attorneys filed the request saying his former attorneys were ineffective for not removing the nine jurors they claim were biased. The claims ranged from coming in prejudiced against Lepsch or the jurors putting more stock in police testimony compared to other witnesses.

Gruenke says it was a fair trial.

"He's claiming that his trial attorneys were ineffective for not realizing these biases or not asking the judge to remove these people, we're arguing that the attorneys didn't really have a basis to remove any of them and there wasn't anything wrong with the jury process as we did it,” said Gruenke.

La Crosse County Judge Ramona Gonzalez has two and a half weeks to consider the arguments.

Lepsch has a hearing scheduled for September 4.
