DES MOINES, Iowa (AP) -

More than 250 residents of two Des Moines apartment buildings may move forward with a class-action lawsuit over a bedbug infestation.

The Iowa Supreme Court says in an order issued Friday it deadlocked with three justices siding with a district court judge's 2011 ruling certifying class-action status and three who would reverse it. One did not participate. That means the Polk County judge's certification of class-action stands.

The building's owners and managers wanted the court to throw out class-action certification.

In 2010, residents of Elsie Mason Manor and Liguitti Tower sued the building owners, Johnston-based First Baptist Housing Foundation, and building managers, Minnesota-based American Baptist Homes of the Midwest. The lawsuit claims managers knew about bedbugs but didn't warn tenants or properly treat for them until the lawsuit was filed.
