SPARTA, Wis. (WKBT) -

The trial for one of the people accused of killing a man at a Tomah motel is underway.

27-year-old Zachary Davis is charged with first degree homicide in the death of 43-year-old Derek Magnuson.

Prosecutors say Davis and his significant other, Sebastian Martinez, who identifies as a female named Sabrina, killed Magnuson in a hotel room the three were sharing in March of last year.

Martinez claims Davis only attacked Magnuson after he tried to assault her while Davis was in the shower.

According to the criminal complaint, Davis and Martinez stole Magnuson's wallet and wiped the hotel room of fingerprints before driving away.

They were eventually arrested in Tennessee.

Davis also faces charges of armed robbery with use of force, and operating a vehicle without the owner's consent.

A trial date for Martinez has not yet been set.
