Onalaska man to stand trial for heroin overdose death
LA CROSSE, Wis. -- An Onalaska man charged with homicide in a heroin overdose death pleads not guilty.
21-year-old Kyle Smith is accused of selling 22-year-old Bradley Benzing heroin before he overdosed November 15.
Smith is charged with first-degree reckless homicide and seven other counts, including felony possession of heroin.
As a hearing Thursday morning in La Crosse County Court, Judge Ramona Gonzalez ruled there is enough evidence for Smith to stand trial. Smith stood mute, and a not guilty plea was entered for him.
According to court documents, officers found about 22 grams of heroin worth $11,000 in Smith's home during a search December 28.
Smith admitted the drugs were his, and told officers he sells about 20 grams of heroin a week, sales he started about six months ago. Before selling heroin, Smith told officers he sold Oxycontin.
